New Federal Lead Abatement Regulations

As of April 22, 2010, any multi-family dwelling older than 1978 must comply with the new federal regulations regarding lead abatement.

Recently, it was necessary for your building superintendent to attend a seminar in an effort to obtain a lead abatement certificate.  I am pleased to report that your building superintendent now maintains a lead abatement certificate. Also, your cooperative has now registered with the Federal Government that they have complied with this new regulation.

Please note our building superintendent who maintains special equipment to detect lead in the paint must first test any construction that you anticipate after April 22, 2010 requiring disturbing any painted areas.  If lead is found to be present, it will be necessary for you to hire only those contractors that maintain a lead abatement certification.  No uncertified contractors will be given permission by management if lead paint is detected.  The penalty issued by The Federal Government if found to be in violation is $32,000.00 per incident.  Obviously if the cooperative is fined it will be necessary to back charge the shareholder in violation.
